TERMS & CONDITIONS
These terms and conditions set out the basis of ordering services from CHT, by requesting collection, you are deemed to have read, understood and agree with all conditions.
Parcels
All parcels must be between the weights of 0-25kg (unless previously arranged); the responsibility of accurately weighing items is entirely with the customer. Weights are taken to be correct, but should they be found to be overweight they will have an excess charge of £2/kg. Any package that is exceeding 25kg must be clearly labelled ‘Heavy Weight’.
Parcels must be clearly labelled up, with the senders and recipients address and postcode, and if possible phone number, and where the location is known to be hard to locate, the details to ensure locating the recipient easily. No liability is accepted by CHT for incorrect/inadequate labelling. An attempt to deliver an item will be assumed to warrant the original charge, and should the item have to be returned to the sender maybe subject to additional charge. Any parcel/s that takes longer than 15 minutes to deliver maybe subject to an additional surcharge.
All parcels must be securely and adequately packaged, CHT take no responsibility, where damage occurs due to inadequate/insecure packing.
It is deemed that the contents of the parcel are legal, CHT retain the right to open any parcel should they have suspicions about it content, and will hand over any illegal contents to the relevant governmental authorities, including the details of the sender and recipient. CHT cannot delivery items containing highly flammable, corrosive, explosive or other dangerous materials.
CHT carries a maximum liability of £10/ parcel, should it be lost, stolen or damaged as a result of actions by CHT. Should additional cover be required, this should be arranged prior to obtaining services.
Every effort will be made to obtain a signature when delivering an item, however, occasion will arise where nobody is available to sign. In such cases, it will remain at the driver’s discretion to leave the item in a secure place and notify the recipient by posting a delivery card at the address. The item will then be assumed to have been delivered. Should the item then become lost, CHT will assess the driver’s decision, and if found to be reasonable, will accept no further liability, CHT’s decision being final. Unless stated or arranged prior to collection the sender will be assumed to be giving consent for this. The sender will have a choice of requesting a proof of delivery, for which there will be a £1 charge, the package must be clearly marked ‘POD’, on collection. If chosen, the parcel will not be left at the location, until a signature is obtained. Should the recipient not be in, a calling card will be left, notifying the recipient that a further attempt will be made the next working day. CHT will waive the guarantee of next day delivery should this occur, and reinstate the delivery for the next day. Should the recipient be unavailable a second time, a further card will be left, requesting the recipient to contact CHT to arrange delivery. Should this fail, the sender will then be notified and the item returned to the sender where appropriate, a further delivery charge being incurred. Should CHT be unable to do this, then after 30 days, the item/s maybe destroyed or sold.
NB. Unless stated otherwise on collection, the signature does not have to be the named person on the parcel.
When a signature is obtained, it is assumed unless stated by the recipient on the signing sheet, that the package has been received in good condition, and CHT accepts no liability thereafter. The customer is responsible for ensuring that the recipient is aware of this policy.
Should the recipient feel that the package/contents have been damaged by CHT, they will agree this with the driver, and subsequently detail it on the signing sheet.
Any loss or damages should be notified to CHT within 14 days of the delivery date. Any late claims will be deemed to be null.
At the point of collection, the customer will pay for the full value of the consignment. They will then be given a receipt, which will act dually as a record of payment, and the parcel being received by CHT.
Full/part loads
All loads must have a weight given to the driver prior to loading. The responsibility of accurately weighing each load is entirely with the customer. Weights are taken to be correct, but should they be found to be overweight they will have an excess charge of £2/kg, plus the full amount of any charges/ legal action incurred by CHT. Once a weight has been accurately been given, it is the responsibility of CHT to ensure that the relevant vehicle is used and no further liability falls upon the customer. All items must be capable of being loaded in a conventional manner, no items that require special loading facilities will be accepted, and where any individual item exceeds the weight of 25kg, assistance must be arranged at both collection and drop of points by the customer.
The customer is to ensure that the recipient is available to accept delivery, and that CHT are aware of the times that the load can be delivered. Should the recipient not be available, CHT will try to contact either the customer, recipient or the sender, and should this not be achieved the load returned to depot. A further charge will then be required for redelivery of the goods to either the original recipient or the sender. If this cannot be arranged after a reasonable amount of time, the goods will then be sold at auction, the total of consignment costs (transport and storage) recovered, and the balance then returned to the customer.
Unless previously arranged, CHT carry no responsibility for the load, on matters that are out of their control. The only responsibility carried by CHT is damage/loss due to driver error/misconduct. The value of any load/part load is deemed not to exceed £500. Should additional insurance for higher value loads be required, the customer must either cover this themselves, or arrange cover with CHT prior to despatch.
On completion of the delivery the customer will be invoiced, this will then be due within the following 7-10 days unless prior arrangements have been made, and a contract signed.
General
The term CHT, signifies the company or any of its employees or temporary staff.
The ‘customer’ is the person or body that pays CHT for the service provided.
The ‘sender’ is the person/body who CHT collect the goods from.
The ‘recipient’ is the person/body who CHT deliver the goods to.
CHT will never unpackage an item without due cause or reason, however should the relevant governmental authorities wish this to be done for any reason, and CHT will comply without taking any liability. At the relevant authorities request we will also have the right to supply all known details (contents/sender/recipient and customer).
Any liability on behalf of CHT is limited to direct loss only, and CHT does not accept liability for loss of profit or business, as such risks can be insured by the customer.
Next Day Guarantee.
CHT guarantees that any parcel collected in one business day will be delivered before close of business the following day. Business days are deemed to be for this purpose, Monday – Friday 9am-5pm excluding bank holidays, unless otherwise stated. In some cases parcels may be delivered the same day as collection in accordance with the vans routing, however CHT accepts no liability from early delivery, or onus to deliver as such. The ‘next day’ guarantee is applicable to requests for collection before 2pm, being delivered before the close of business the following working day. In some cases where a vehicle is not available, the parcel/s will be collected the following morning, still being delivered within the original time schedule. The delivery time guarantee is limited to normal working conditions, and is not applicable in cases of Force Majeure.
Force Majeure.
CHT is not liable for lateness of collecting/delivery arriving from war, civil commotion, explosion, strikes or other types of industrial disputes, failures of a transport network or utility service, fire, storm, flood, severe weather or other situation beyond CHT’s control.
CHT will not normally provide proof of delivery, only when a dispute has arisen, will they send a copy of the relevant part of the signing sheet to the customer.
The customer is responsible and liable for ensuring that any employee from CHT shall be able to work safely, legally, and free from harassment and discrimination, whilst carrying out their duties at the collection and delivery addresses.
The customer agrees that CHT may, without notice or further charge to the customer, arrange that the consignment be carried by a sub contactor. In this event all parties will still maintain these terms and conditions.
Customers, who provide incorrect/inaccurate details to CHT, to obtain service at a cheaper price, will have service suspended.
